All bookings of holiday accommodation whether made by telephone, e-mail, in person, in writing or over the internet are accepted by Newquay Holiday Lets acting as agent on behalf of the Owner subject to the following terms.

You are deemed to have accepted these terms on your first use of the website. We reserve the right to change the content on the Website (newquayholidaylets.co.uk) as we may deem necessary. Where alterations are made, you are deemed to have accepted the new terms on your first use of the website following the alterations. We advise that you visit and read the terms and conditions page each time you visit the website.

It is your responsibility as the reader to ensure that you have lawfully accessed the website. Newquay Holiday Lets Ltd accepts no responsibility for unauthorised access or unauthorised actions taken by the reader.


The following definitions and rules of interpretation apply in these Conditions:

Booking Confirmation: the booking confirmation provided to the customer via email when a booking has been accepted.

Booking Deposit: 20% of rental fees upon booking.

Booking Fee:

Rental Fees: the total amount due from a Customer for the booking of the Property.

Rental Period: the rental period specified in the Booking Confirmation.

Customer(s): the Customer(s) booking holiday accommodation.

Guest(s): the people that occupy the Property subject to these Conditions.

Owner: the owner of the Property.

Property: the holiday accommodation made available (subject to these terms and conditions) to the Customer(s) and/or Guest(s) for use for the purposes of the Booking.

Inventory: fixtures, furniture and fittings at the Property.

Newquay Holiday Lets: Newquay Holiday Lets Ltd Company Registration 12724361

Event Outside Reasonable Control: any act or event beyond Newquay Holiday Let’s or the Owner’s reasonable control, including without limitation storm, flood, fire, natural disaster, epidemic, failure of public or private telecommunications networks or industrial action.


All bookings of holiday accommodation whether made by telephone, e-mail, in person, in writing or over the internet are accepted by Newquay Holiday Lets acting as agent on behalf of the Owner. The contractual relationship is directly between the Owner and the Customer.

Upon written request, Newquay Holiday Lets will provide the name and address of the Owner to the Customer.


Bookings will be reserved upon receipt of the 20% booking deposit and booking fee to Newquay Holiday Lets. If two or more Properties are booked for rental, these constitute separate contracts and are subject to separate Booking Fees.

The remainder of the full Rental Fees is due for payment ten weeks before the Rental Period commencement date. This will be outlined in the booking confirmation. It is the Customer’s responsibility to remember this date. Newquay Holiday Lets will not send reminders.

If the balance of Rental Fees is not paid by the Customer on the due date, then the Customer will be deemed to have cancelled their booking. Newquay Holiday Lets shall retain the Booking Deposit and the Booking Fee.

Confirmation of Booking

The Customer’s submission of a booking is an offer to book the Property. If the Property is available on the requested dates, Newquay Holiday Lets will send the Customer a Booking Confirmation. At this point, these Terms and Conditions come into effect and this is a binding contract.

Newquay Holiday Lets reserve the right to refuse a booking request for any reason. Where a booking is denied, we will aim to tell you why as soon as possible and the Deposit, Rental Fees, Booking Fee and any other charges paid by the Customer will be refunded immediately.

Newquay Holiday Lets does not accept Bookings from Customers under 18 years of age and reserves the right to cancel a Booking made by anyone who is (or is reasonably suspected to be) under 18 at the time the Booking was made. Newquay Holiday Lets does not accept bookings from Stag or Hen parties.

Payment Method

All payments made to Newquay Holiday Lets may be made by credit card, debit card.

All payments shall be made in Sterling GBP.

Booking Amendments

Amendments to bookings, where applicable and accepted by Newquay Holiday Lets (on behalf of the Owner), will be subject to an administration fee of £35 for each amendment.

Property’s cancellation policy

In the event of the cancellation of the booking by the Client the total payable in respect of the holiday will remain due. If the agent is able to re-let the accommodation for the relevant period (or any part of it) the Agent will refund to the Client eighty per cent of any amount received in respect of the re-letting.

Whilst all bookings are accepted in good faith, in the unlikely event of an occurrence making it necessary for the Agent to cancel the booking, the Agent’s liability shall be limited to monies paid by the client in respect of the booking. Wherever possible, however, alternative accommodation will be offered.

We are continuing to take bookings and are reviewing all the COVID-19 restrictions as and when they are updated.

Please note any bookings made after lockdown and onwards are subject to our standard terms and conditions, unless further government restrictions prevent travel. If you decide to cancel, when there are no restrictions in place, you will be subject to our standard refund policy and no refund will be given, unless the property can be re-let for all/or part of your booking dates.

If you have holiday booked and choose not to travel, outside of the government restrictions (disinclination to travel) then our standard cancellation terms will apply.

If you are unable to travel due to government regulations, we can issue a full refund or offer alternative dates.



Whilst Newquay Holiday Lets undertakes all reasonable care to ensure information is up to date and accurate at the time of publishing, information is subject to change. Newquay Holiday Lets accepts no liability for losses or claims arising directly or indirectly from use of this information. It is outside of the control of Newquay Holiday Lets if amenities in the surrounding area close and whilst we aim to provide up to date information for general informational purposes, this information should not be used either partially or wholly as advice on which Customers and Guests should rely.

Non-Availability of Property

In the unlikely event that a Property is not available during the Rental Period as a result of an Event Outside Reasonable Control, Newquay Holiday Lets and/or the Owner may cancel the booking. In such instances the customer will be contacted as soon as is reasonably possible and offered the following options:

  • To transfer the Rental Date to an alternative date (subject to availability).
  • To request a full refund of payments made so far in relation to the booking.

Customer Responsibilities

For the duration of your stay at the Property, you will be responsible for the Property and will be expected to take all reasonable care of it.

Properties must be vacated by 10:30 on the date of departure.

If any additional fuel or energy costs are incurred during the stay outside of the Rental Fees, the Customer is responsible for paying them.

Any loss, damage, destruction, defect or disrepair must be reported to Newquay Holiday Lets as soon as the Customer becomes aware of it. The reasonable costs of any miscellaneous repairs and/or replacements outside of reasonable wear and tear during the Booking Dates by the Customer(s) or Guest(s) shall be payable on demand to Newquay Holiday Lets who may also, at their discretion, refuse further bookings.

Where an inventory is provided, any discrepancies must be reported to Newquay Holiday Lets within 48 hours of the start of the Rental Period. Any discrepancies found outside of this period will be charged to the Customer.

Cleaning services are not provided for properties unless expressly stated and therefore the Customer(s) must leave the Property as clean and tidy as they found it. If a property is not left clean and tidy, additional costs will be incurred by the Customer.

The Customer must not smoke in the Property or to be of nuisance to adjacent property occupants.

The Customer must only use allocated parking spaces agreed upon with Newquay Holiday Lets.

The Customer must permit the Owner and/or Newquay Holiday Lets access to the property at all times without notice. Usually this would be on rare occasions to carry out maintenance or repairs.

The Customer must not transfer the booking to another party without securing prior consent from Newquay Holiday Lets.

The Customer must not exceed the total number of occupants for the Property, as agreed as part of the Booking Confirmation.


Pets are only permitted to enter the Property with prior written consent for Newquay Holiday Lets or the Owner. You are not permitted to leave pets unattended at the property at any time and pets are expected to be under control at all times. In some instances, pets will only be permitted access to certain areas of the Property (i.e. not on furniture or in bedrooms). This will be made clear prior to the Rental Date. Please be aware that some beaches do not permit dogs during peak seasons.

Please be aware that pets may have visited a Property that is not listed as allowing pets at a previous date (i.e. Assistance Dogs or Owners pets). The Owner cannot accept responsibility or liability for any suffering, damages or losses which may occur as a result of this.

Assistance Dogs

Newquay Holiday Lets are happy to accept Assistance Dogs upon obtaining permission from the Owner of the Property.


Newquay Holiday Lets acts only as the agent for the Owner and is not responsible for any neglect on their part. The Owner is solely responsible for the safety of the Property and all Guests. Newquay Holiday Lets accepts no responsibility for personal injury to, or death of, any guests, or loss of or consequential loss or damage to their property.


Newquay Holiday Lets requests that all complaints are reported as soon as reasonably possible. The Customer agrees the Newquay Holiday Lets and/ or the Owner are given the opportunity to investigate and resolve complaints within a reasonable time and to resolve them.


This contract is governed by the law of England and Wales. Disputes can be submitted to the jurisdiction of the courts of England and Wales, or, where the customer lives in Northern Ireland or Scotland in their respective courts.

All website content is subject to copyright and may not be used or reproduced without Newquay Holiday Lets expressed written permission. Material may be downloaded, printed or copied for personal non-commercial use only. No alterations or additions may be made to the content. Newquay Holiday Lets accepts no liability for any damage to or viruses that may infect your computer or access device, software or property as a result of using this website or downloading any material from it.


We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information. These Terms and Conditions should be read alongside and in addition to our Privacy Policy. For the purpose of these Terms and Conditions: ‘Data Protection Laws’ means any applicable law relating to the processing of personal data, including but not limited to the Directive 95/46/EC (Data Protection Directive) or the GDPR. GDPR means the General Data Protection Regulation (EU) 2016/679; ‘Data Controller’, ‘Personal Data’ and ‘Processing’ shall have the same meaning as in the GDPR.


We are a Data Controller of the Personal Data we Process in providing Services to you. When processing your data we will comply with our obligations imposed by the Data Protection Laws:

Before or at the time of collecting personal data we will identify the purposes for which it is being collected;
